This page contains evidence of how citizens rights were violated by Florida State officials including forcing plans opposed by the public, refusal to allow a referendum on a public issue, official State Advisory group violation of stated mission, conflict of interest, violation of neutrality,  lack of representation, violations of Democracy and the Florida Attorney General’s office failing to respond to complaints about this matter.

Wild Waters in Silver Springs Florida was built by ABC Television in 1978 and it’s one of the South’s first Water Parks. It’s one of the first Water Parks to use fiberglass slides.  It provides over 60 summer jobs.

 

The sister park, Silver Springs Park was one of the nations first national attractions and is home of the world famous Glass Bottom Boats.  It was owned by ABC Television from 1962 to 1984.   Movies such as Tarzan, Creature from the Black Lagoon, scenes from Legend and James Bond were filmed at Silver Springs.  It’s also where TV shows such as Sea Hunt was filmed.

Palace Entertainment had been managing Silver Springs & Wild Waters since 2002. Governor Rick Scott (Republican) let Palace Entertainment out of their contract in 2013 which was supposed to run until 2029.

As a result of Governor Scott letting Palace Entertainment out of their contract, Wild Waters & Silver Springs was put under the control of bureaucrats from the Florida Park Service and Florida Department of Environmental Protection.  This  turned out to be devastating to the people in central Florida.

Since the State of Florida took over Silver Springs park, we have suffered a considerable downgrade in services and entertainment. They eliminated the small zoo, the animal shows, rides like the safari ride, boat rides, kids attractions and more. As a result, there is barely anything left worth going to Silver Springs to see.

Every year, we used to have fireworks and concerts at Silver Springs on the 4th of July. Since the State of Florida took over, there were no fireworks and no concert in 2014.

Above is a typical complaint about how Silver Springs is being managed now.

Eliminating attractions at Silver Springs was only the beginning.  Next, Florida State bureaucrats decided to eliminate our Water Park, Wild Waters.

Wild Waters being under the control of the Florida Department of Environmental Protection is in self is clearly a conflict of interest because the objectives and mission of the Department of Environmental Protection is at odds with the operation of a Water Park.

Despite over 3,400 people signing the petition, the Florida Department of Environmental Protection announced on 12-12-14 that Wild Waters will be closing at the end of the 2016 season.

Eliminating Wild Waters was not due to a lack of attendance, it’s because Florida State bureaucrats wanted to use the property for a more “Park Like Setting” and don’t care what the public wanted as shown in the video below.

 

Why the Florida Park Service Closed Wild Waters Water Park

Wild Waters in Silver Springs, FL was closed & tore down by the Florida Park Service & State of Florida against the will thousands of citizens who wanted the Water Park Preserved and Restored.

.In the above video, Silver Springs Park Manager Sally Lieb states; “You’ve got the State Park , the Greenway & trails, and there’s the huge national forests, so we want that corner to represent that and having the water park there doesn’t give anybody that feeling when their heading in that direction”.

That statement proves eliminating Wild Waters was all about what THEY wanted.

 

 

This Official Florida Organizational Chart clearly shows that the citizens of this state are above all Government Officials.

Since Wild Waters was owned by the State of Florida, Wild Waters was owned by Florida citizens.  Florida citizens also pays every Florida State Official’s salary so they should be doing what the citizens of this state want.

Eliminating our water park because “having the water park there doesn’t give anybody that feeling when their heading in that direction” demonstrates that Florida State Officials only care about what they want and do not care about the wishes of the citizens they are supposed to be serving.

If you read the comments after the article “Wild Waters days are numbered” and “Silver Springs Advisory Group Recommends Closing Wild Waters“, you would see comments from people who were dismayed and outraged by plans to close our Water Park.

Copies of the comments and links to where the comments can be viewed have been sent directly to many State Officials including Gov Rick Scott and no response was ever received.

As a result of Governor Rick Scott letting Palace Entertainment out of their contract which had been managing Wild Waters, an advisory group was formed which gave primarily un-elected people the authority to make recommendations about the fate of Silver Springs and Wild Waters.

This advisory group was suppose to “best reflects the public’s ideas for its future” .  As you will see, this advisory group did NOT reflect the public’s wishes.  Citizens wishes were not represented and their rights were violated.

The Silver Springs Advisory Group was comprised of business people, State Officials and 2 publicly elected representatives. The two publicly elected officials who were members of the Silver Springs Advisory Group are; Mayor of Ocala, Mr. Kent Guinn and Marion County Commissioner Stan McClain. Since Wild Waters is owned by the State of Florida, Wild Waters is owned by Florida citizens.  Florida State Officials should uphold citizens wishes to keep Wild Waters in our community and citizens should be entitled to a vote to make sure Wild Waters is preserved.

The following proves that Florida Citizens was not been properly represented and Democracy was violated.

1.  Click the PDF below download a letter from Chief Office of Park Planning, Mr. Lew Scruggs to Marion County Commissioner Mr. Stan McClain in regards to the Silver Springs Advisory Group meetings.

Note in the second paragraph that the document states “We expect that this focus group approach to planning will be of great benefit to our long-term visioning process for the state and help produce draft plan that best reflects the public’s ideas for its future”.

Proof that the Silver Springs Advisory focus group has not “reflected the public’s ideas” is the fact that over 3,400 people signed a petition to preserve Wild Waters and the Silver Springs Advisory Group ignored the petition.

Therefore the Silver Springs Advisory Group violated it’s stated mission.

2.  On May 6, 2014, a member of the Save Wild Waters Group took copies of the petition to a Ocala City Council meeting and ask them to take action to make sure Wild Waters was preserved for citizens in Florida.  No one at the meeting said they would do anything to make sure Wild Waters was preserved.

Elected officials are paid to represent their constituents.  Ignoring the pleas of over 3,000 people, many of whom live in the Council members districts demonstrates negligence and apathy by Ocala City Council members.

3.  On May 6, 2014, a member of the Save Wild Waters Group took the petition to the Marion County Commissioners (all are Republicans) and asked them to make sure Wild Waters was preserved for citizens in Florida.

They were also asked to put a referendum on the ballot so the people of Marion County Florida could vote on keeping Wild Waters.

The request to make sure Wild Waters was preserved and the request to put a referendum on the ballot so citizens could vote on keeping Wild Waters was ignored.

Since Wild Waters is owned by the State of Florida, Florida citizens owns Wild Waters. State Officials should respect citizen’s wishes to keep this Water Park in our community and we should be entitled to a vote.

4.  The Star Banner article “Wild Waters days are numbered” stated “County Commissioner Stan McClain, a member of the task force and the commission’s main champion for refocusing the facility toward ecotourism as a way to help the springs and create jobs, said the plan has provided a framework for accomplishing the county’s objectives”.

That statement indicated that Mr. McClain represented the wishes of 5 people, the Marion County Commissioners, not the citizens of Marion County.  Therefore, Mr.  McClain failed to represent citizens wishes as a member of the Silver Springs Advisory Group.

5.  In June, 2014, a member of the Save Wild Waters Group asked Mr. McClain in a letter, in view of the fact that over 3,000 people signed a petition to save Wild Waters if he would change his mind about supporting plans to have Wild Waters demolished in 3 – 5 years.

Mr. McClain stated that he would not support any plans which include saving Wild Waters stating cost to taxpayers as a reason.  That proves that his mind was made up and he was not representing citizen’s wishes as a member of the Silver Springs Advisory Group.

Also, the statement he made regarding cost to taxpayers is an invalid excuse because “taxpayers” signed the petition and stated they want Wild Waters to be preserved.

As mentioned in the Star Banner article “Wild Waters days are numbered”, the proposed changes to Silver Springs would run between $15 million and $20 million, so if there’s that kind of money available for Silver Springs, then there is plenty of money available to restore and preserve Wild Waters.

It seems that Mr. McClain has no problem spending tax payers money as long as it’s being spent the way he and Marion County Commissioners want.

6.  In December 2014, a letter was sent to each Marion County Commissioner on behalf of the over 3,000 people who signed the petition asking them to stand up for the people in Marion County and make sure Wild Waters was preserved.

ALL of the Marion County Commissioners ignored the letter and they took no action to represent the wishes of the citizens they are supposed to serve.

7.  Florida Citizens not Properly Represented / Lack of Representation

The Mayor of Ocala, Mr. Kent Guinn has stated he supports Wild Waters being preserved.  He is one of the two publicly elected members of the Silver Springs Advisory Group.

On the day the Silver Springs Advisory Group submitted their plans to the Acquisition and Restoration Council (December 12, 2014), he was not able to attend the meeting and tell the ARC that he felt Wild Waters should be preserved. Why? Because he was not informed about the meeting until one day before the meeting was to take place.

Since he was not given adequate notice and was not able to attend the meeting, citizens were not properly represented.

Even though Mr. Guinn wasn’t able to attend the meeting, key members of the Silver Springs Advisory Group received copies of the petition.  They were well aware that the public wanted Wild Waters to be preserved but chose to ignore the public’s wishes.  In doing so they violated the Silver Springs Advisory Group’s stated mission to “best reflects the public’s ideas”.

8.  A  copy of the entire petition signed by over 3,000 people and their comments about how upset they are about plans to eliminate Wild Waters was sent to Mr. Hank Vinson, Staff Director of the Acquisition and Restoration Council on June 5, 2014.

A copy of a video was also included with Ms. Sally Lieb, the Silver Springs Park Manager stating;  “having the water park there doesn’t give anybody that feeling when their heading in that direction”.

Mr. Vinson stated in a email that he distributed the petition, comments and video to Acquisition and Restoration Council members.  So every ARC member was well aware that the public was adamantly against plans to eliminate Wild Waters.

9.  Conflict of Interest and violation of neutrality

As you can see from the 2 above photos, Katy Fenton is a member of the Silver Springs Advisory Group. She is also the Chairman of the Acquisition and Restoration Council, the department that makes the decision weather or not to accept the Silver Springs Advisory Group’s recommendations, including the decision to eliminate Wild Waters.

Ms. Fenton being a member of the Silver Springs Advisory Group and Chairman of the Acquisition and Restoration Council appears to be a conflict of interest and violates the principle of neutrality.  This is like allowing a prosecutor to also be the judge and jury.

ADDITIONAL CONFLICT OF INTEREST

Wild Waters for some unknown reason has been put under the control of the Florida Department of Environmental Protection.

This in its self is clearly a conflict of interest because the objectives and mission of the Department of Environmental Protection is at odds with the operation of a Water Park.

10. A letter was sent directly to Katy Fenton on 6/13/14 by email about the petition.  The letter asked her to make sure Wild Waters was preserved for families in Florida and she ignored the letter.

A similar letter was sent to other members of the Silver Springs Advisory Group such as Mr. Lew Scruggs, Chief Office of Park Planning.

11. This Florida Organizational Chart shows that the citizens of this state are above all Government Officials.

Governor Rick Scott, members of the Silver Springs Advisory Group, Florida Park Service, Acquisition & Restoration Council and Marion County Commissioners received a copy of the petition. ALL of them choose to ignore the wishes of the citizens of this state.

Members of the Advisory Group & Park Service have used the excuse that they held 5 public workshops in Ocala and they gave the public an opportunity to express their opinions.

The fact is that members of the Advisory Group, Park Service and Acquisition and Restoration Council received copies of the petition so they knew citizens wanted to keep Wild Waters and should have known there was strong opposition to Wild Waters being removed.

The petition had over 3,000 signatures by May 25, 2014.  Letters were sent to members of the Advisory Group & Park Service at the end of May 2014 informing them of the petition.  The meeting in which the Advisory Group submitted their plans to the Acquisition and Restoration Council was held on December 12, 2014. So the Advisory Group had plenty of time to make adjustments which would include Wild Waters being preserved.

It is important to note that the petition is the only indicator available which represents the public’s wishes regrading Wild Waters.  That data shows that the public wants Wild Waters to be preserved.

The Advisory Group, Florida Park Service and Department of Environmental Protection and the Marion County Commissioners has not obtained one (1) signature which support their plan to close our Water Park.  So they have no way of proving there is any public support for closing Wild Waters in at the end of the 2016 season.

These issues prove that Florida State officials have virtually ignored Florida Citizens who supported keeping their Water Park and failed miserably to represent them.  And that members of the Advisory Group, Park Service and Acquisition and Restoration Council had no intentions of listening to the public or doing what the public wanted. 

By failing to represent the wishes of the pubic, the Silver Springs Advisory Group violated it’s stated mission to “best reflects the public’s ideas”.

The Ocala Star Banner article titled, “Wild Waters Days are Numbered” – says that plans to reintroduce swimming in the main spring “would make the Water Park obsolete”.

That is a ridiculous statement and demonstrates how totally out of touch members of the Advisory Group & Florida Park Service have been in regards to what the public wants.

Swimming in the main spring will never be a substitute for a Water Park.

The people have spoken and they want Wild Waters to stay.  They do not want “swimming in the main springs” as a forced substitute.

The fact that a handful of mostly un-elected people have been given the authority to make decisions which could affect thousands of people plus Marion County Commissioners not listening to citizens and refusing to allowing citizens to vote on this important issue violates Democracy.

The fact that thousands of people patronize Wild Waters each year proves people want this Water Park to remain open.

These Park Service bureaucrats want to eliminate our Water Park and spend between $15 million and $20 million on Silver Springs to “refocus the facility toward ecotourism”.

Eliminating Wild Waters plus eliminating attractions from Silver Springs and “refocusing the facility toward ecotourism” is not what Florida citizens want. We already of TONS parks and trails.   This is example of the poor planning and management within the Florida Park System and Marion County Commissioner’s who support such a plan.

We need more attractions at Silver Springs, not less. The lack of attractions is why attendance at Silver Springs declined in the first place.

Also, when Palace Entertainment managed Silver Springs and Wild Waters, you could buy yearly season passes for both parks. Eliminating season passes for Silver Springs and Wild Waters has also contributed to a decline in attendance.

If you have ever ridden the glass bottom boats at Silver Springs you would have seen snakes, alligators, turtles and other wildlife. Opening swimming in the main springs would infringe upon the wildlife which inhabit the springs. Also, since snakes, alligators and other wildlife inhabit the springs, there is no way to guarantee they will not harm humans who are infringing on their natural habitat.

It would be much better to spend money on Wild Waters, than waste it on a Park Swimming Hole that no one wants, and which would infringe on Wild Life.

A child was killed by an alligator recently at Disney World in Orlando.  If anyone is injured by wildlife at Silver Springs it will be the fault of those who refused to listen to the thousands of citizens who signed the petition.

Wild Waters serves a large area which includes Marion, Alachua, Levy, Putnam, Citrus, Lake and Sumter Counties. It is also a tourist attraction and provides traditional summer jobs for young people.  Comments have been received from people all over the United Sates stating they come to Ocala every year to visit Wild Waters.

There are over 1,400 golf courses in the state of Florida, but very few Water Parks in comparison. Some of these golf courses are taxpayer subsidized.

It has been reported that approximately $100 Million dollars was raised and spent on Rick Scott’s 2014 re-election campaign.

If there’s money for Golf Courses and millions for politicians to get themselves elected, there should be funds for Wild Waters so families have a local place to take their children, and people of all ages can enjoy water slides and the wave pool during the summer.

It all comes down to priorities, and it appears that bureaucrats who want to use the property for a more “Park Like Setting”,  Golf Courses and millions for politicians are more important than a Water Park for families and children in our area.

Wild Waters is one of the few things young people have to enjoy in our area during the summer.

If our Water Park were to be closed it would be devastating to thousands of families, children and teens in Central Florida who enjoy going there every year during the summer. It would cause a hardship on families causing them to have to drive up to two hours to the next closest water parks in Orlando, Tampa or Daytona. Many would not be able to take their children to a water park at all during the summer due to the long drive.

$800,000 Tax Payer Money Wasted by Florida State Officials

According to this article posted in the Ocala Star Banner, http://ocala.com/news/20150612/fun-new-additions-at-wild-waters, $800,000 was spent on Wild Waters in repairs.

That money has been totally wasted by the DEP and Florida Park Service, plus much more tax payer money on demolition costs.

This water park was generating revenue and providing jobs.

 

Ultimately, Rick Scott is responsible for the loss of our Water Park, jobs and the degradation of entertainment at Silver Springs.  As stated previously, the company, which was managing Silver Springs and Wild Waters was Palace Entertainment. Their contract was not due to expire until 2029.  If Governor Scott had not let Palace Entertainment out of their contact, Wild Waters would have continued to operate until at least that date.

After releasing Palace Entertainment from their contract which would have ran until 2029, Governor Scott should have made sure Wild Waters was preserved until at least 2029 for the people in Central Florida.

Gov Scott should have found another management company similar to  Palace Entertainment instead of putting Wild Waters under the control of the Florida Department of Environmental Protection and the Park Service.

Gov Rick Scott made a huge mistake putting letting Palace Entertainment out of their contract and putting Wild Waters under the control of the Florida Park Service.  Florida citizens are paying for his mistake.

Governor Rick Scott talked about creating jobs. Closing Wild Waters caused the loss of over 60 summer jobs, many which are filled by young people.

Despite numerous people calling and writing Governor Rick Scott, asking him to make sure Wild Waters is preserved, he didn’t have the decency to respond or do anything to stand up for the people in Central Florida.

 

Complaints were sent to Mr. Jon Steverson, Secretary of the Florida Department of Environmental Protection about all of the issues on this page and so far, there has been no acknowledgement or response from him.

 

Copies of the petition were given to the Marion County Commissioners (all are Republicans), members of the Silver Springs Advisory Group, members of the Acquisition and Restoration Council, and they ignored the petition.

 

Letters were sent to Mr. Donald Forgione, Director of Florida Park Service, Silver Springs Park Manager Ms. Sally Lieb, Republican House Majority Leader Mr. Steve Crisafulli, Republican Senate Majority Leader Ms. Lizbeth Benacquisto, Silver Springs Republican Representative Robert C. Schenck and the Ocala City Council.  ALL of them ignored the letters and has done nothing to stand up for the citizens they are supposed to be serving.

Complaints were filed to Florida Attorney General Pam Bondi (Republican) and the Florida Attorney General’s Office about all the issues on this page, including citizens rights being violated and to date, there has been no response from Pam Bondi or the Florida Attorney General’s Office.

Florida State Officials has not listened to the very citizens who pays their salaries and they have proven that they could care less what the public wants.

It is also clear that Florida Citizens wishes are not being represented or respected by Florida State Officials.

Every person who has ignored the petition signed by over 3,400 people and has failed to respond to complaints regarding this matter has proven themselves to be grossly negligent, unworthy of public trust and unfit for office.

It was simply the preference of a hand full of bureaucrats who do not care what citizens they are supposed to be serving want.

This is ultimately about democracy and the will of the people being upheld.

Florida government officials ignoring the wishes of the citizens of this state and refusing to let the people vote on keeping our Water Park goes against everything democracy is supposed to stand for.

UPDATE: August 27, 2018

According to an article by the Star Banner Newspaper titled, “Diving in and going big” the Marion County Commissions wants to spend 23 million dollars for a new Aquatic Center.

Every member of the Marion County Commission should be well aware that their constituents wanted Wild Waters preserved.

Since it appears the Marion County Florida Commissioners have the ability to come up with 23 Million Dollars, they should have taken action to have Wild Waters restored or re-built. The fact that they didn’t proves they don’t give a DAMN about their constituents.

It would have been a lot less expensive to fix up the Water Park we had, which so many people loved. Anyone can look at the above drawings and see that the “Aquatic Center” they’re considering doesn’t hold a candle to Wild Waters and is NOT what the people wants.

WE WANT WILD WATERS TO BE REBUILT!

 

In response, a new petition was created in January 2019 to rebuild Wild Waters.

In less than one week, 8,000 people signed the petition. Within 2 months, over 10,000 people signed the petition demanding Wild Waters be re-built. This is almost 3 times the number of people who signed the original petition.

Every member of the Marion County Commissioners, the Ocala City Council members and the Mayor were sent letters to inform them about the new petition with over 10,000 signatures and once again, ALL choose to ignore the letters and their constituents proving they could care less what the citizens they are supposed to be serving want. In my opinion, they all are unfit to “serve” in any position in Government.

As described on this page, every elected and non-elected state officials has failed to uphold and respect “the will of the people” proving there is a total lack of democracy in this state.

In December 2018, the Florida Park Service began Demolition, Against the will of the People.

People were heartbroken and outraged about our beloved Water Park being destroyed. Here’s a few of their comments;

 

As of 9-6-20, over 12,000 people signed the petition proving there’s an interest in having Wild Waters re-built.

What we’re envisioning would be similar to the Daytona Lagoon… a complex with not only with a Water Park but Putt-Putt Golf Course, Arcade and Go Kart Racing.
 
The County Commissioners, City Council and Ocala Mayor should at least be helping since their paid to present their constituents.

Instead, they have ignored the petition and all correspondence about this, proving once again… they don’t care about their constituents and are UNFIT to hold elected office.

Ads WILL be ran at some point in the future exposing this entire matter. This is a classic example what’s wrong with our government and people all over the United States should be made aware of this outrage.
